Acknowledgment: By placing an order with I’m Truly Grateful Cookies, you acknowledge that you have read, understood, and agreed to these Terms and Conditions designed to protect our handcrafted artisanal confections and maintain the exclusivity of our boutique bakery, including our policies regarding payments, refunds, returns, and delivery responsibilities.
1. ORDERS AND CUSTOMIZATION
Order Approval: All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our discretion.
Order Preparation: As a boutique bakery, all items are prepared in small handcrafted batches. Depending on order volume, preparation may require up to eight (8) days.
Custom Orders: We do not offer custom cakes or decorated cookies. All pricing is fixed and non-negotiable.
2. PRICING AND PAYMENT
Pricing: All prices are listed in United States dollars and are subject to change without notice. Promotional offers may be subject to additional terms and limitations.
Minimum Order: A minimum purchase of thirty-five dollars ($35), excluding tax and delivery fees, is required for all local deliveries.
Accepted Payments: We do not accept cash, Cash App, Zelle, or other in-person payment methods. All payments must be completed online through PayPal. Major credit and debit cards, including Visa and Mastercard, may be accepted through PayPal’s processing system.
Payment Authorization: Customers are responsible for ensuring all payment information is accurate and authorized before submitting an order.
Chargebacks and Payment Disputes: Due to the perishable and custom nature of our products, all sales are final. Customers agree to contact us directly to resolve any concerns before initiating a chargeback or payment dispute. Fraudulent or abusive chargebacks may be disputed to the fullest extent permitted by law.
3. SHIPPING AND DELIVERY
Fulfillment: Orders are fulfilled in the order received. Delivery and shipping times are estimates and may vary depending on order volume, holidays, weather conditions, or carrier delays.
Delivery Fees: Delivery fees vary based on location and distance. Local delivery rates start at eight dollars ($8) and may increase up to thirty dollars ($30) for select areas, including Prosper, Frisco, and Little Elm.
Delivery Information: Customers are responsible for providing accurate and complete delivery information. We are not responsible for delays, failed deliveries, or additional fees resulting from inaccurate or incomplete information.
Receiving Your Order: Someone must be available to receive the order at the time of delivery. Hand delivery is prioritized. Porch delivery is available only upon written request from the customer. Once an order has been delivered according to the customer’s instructions, responsibility transfers to the customer.
Third-Party Carriers: We are not responsible for delays, damages, or losses caused by third-party carriers, including but not limited to the United States Postal Service (USPS), UPS, or other delivery providers.
Tips: Tips for delivery personnel are optional and appreciated.
4. PRODUCT QUALITY AND CARE
Handcrafted Variations: Each item is handcrafted using premium ingredients and may contain slight variations in appearance.
Temperature Sensitivity: Some products may be sensitive to temperatures as low as 60°F. Customers are responsible for ensuring proper storage conditions immediately upon receipt.
Post-Delivery Damage: We are not responsible for melting, spoilage, or damage caused by heat exposure, improper storage, delayed retrieval, or mishandling after delivery.
5. REFUNDS, RETURNS, AND EXCHANGES
All Sales Are Final: Because our products are perishable food items, we do not accept returns or exchanges. Refunds are not provided except where required by applicable law.
Order Issues: If there is an issue with your order, customers must contact us within twenty-four (24) hours of delivery with photographs and order details so we may review the matter.
6. CUSTOMER RESPONSIBILITIES
Customers agree to:
Verify all payment and delivery information before placing an order.
Ensure someone is available to receive the delivery.
Provide clear delivery instructions when necessary.
Inspect orders promptly upon receipt.
7. GENERAL TERMS & GOVERNING LAW
Changes to Terms: We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our services constitutes acceptance of any revised terms.
Governing Law: These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas.
Conflict Resolution: We are committed to resolving customer concerns professionally and respectfully. Customers are encouraged to contact us directly regarding any issues.
